LIABILITY WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT
By registering for and participating in any classes, workshops, private lessons, events, or activities offered by Ole Beats In Motion (including but not limited to Kizomba and Semba dance instruction), I acknowledge and agree to the following:
1. Assumption of Risk
I understand that dance instruction and partner dancing are physical activities that involve inherent risks, including but not limited to:
- Slips, trips, and falls
- Muscle strains or sprains
- Joint injuries
- Physical contact with other participants
- Aggravation of pre-existing conditions
I voluntarily and knowingly assume full responsibility for any risks of injury, illness, or property damage arising from my participation in classes, events, or related activities offered by Ole Beats In Motion.
2. Release of Liability
To the fullest extent permitted by the laws of the State of Maine, I hereby release, waive, discharge, and hold harmless Ole Beats In Motion, its owners, instructors, assistants, employees, contractors, agents, venue partners, and representatives from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in any class or event.
This release includes claims based on ordinary negligence but does not apply to gross negligence or willful misconduct where prohibited by law.
3. Participant Representation
I represent and warrant that:
- I am at least 18 years of age.
- I am physically fit to participate in dance classes and activities.
- I have no medical condition that would prevent my safe participation.
I understand that it is my responsibility to consult a physician prior to participating if I have any health concerns.
4. Medical Authorization
In the event of injury or medical emergency, I authorize Ole Beats In Motion to obtain medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical costs incurred.
5. Personal Property
I understand that Ole Beats In Motion is not responsible for any lost, stolen, or damaged personal belongings brought to classes or events.
6. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Maine.
7. Acknowledgment and Electronic Acceptance
By checking the acceptance box during account registration, I acknowledge that:
- I have read this Agreement in its entirety.
- I understand its terms and legal consequences.
- I voluntarily agree to be legally bound by this Agreement.
I understand that my electronic acceptance constitutes a legally binding agreement.
